Another suit against Lohan, following latest arrest: Cops Had "Guns Drawn" After Chase

A woman who says she was in the car Lindsay Lohan was chasing the night she was arrested for her second DUI has sued the troubled actress, saying Lohan "put me through one of the most frightening experiences of my life."

According to the suit, Tracie Rice was in the SUV driven by Michelle Peck, the mother of LiLo's former assistant. Rice says she "was convinced that their lives were in danger and that they had to outrun the pursuing car or they might be killed." The night of the incident, Rice claims Peck was so terrified at being chased by Lohan that she drove through a barricade and into the parking lot near the Santa Monica Police Station. Rice says she jumped out of the Cadillac Escalade and ran toward police officers and saw a woman, who turned out to be Lohan, run from another SUV toward her. "Police officers approached all of them with guns drawn," the suit said.

The suit was filed today in Los Angeles County Superior Court. She's suing LiLo for intentional infliction of emotional distress, and also seeks unspecified damages and payment of medical and other expenses.

As TMZ first reported, three men in the car with Lindsay that night say she commandeered a car and took them hostage.

LiLo cleans up nice for OK! mag shoot at Utah rehab - & DA may ease coke charges

Leave it to Lindsay Lohan to plan a glossy photo shoot from inside rehab - inviting OK! magazine to snap away at the fancy Cirque Lodge detox center in Sundance, Utah.

In one perfectly posed shot, a demure Lohan, her hair pulled tightly back, is reading "Alcoholics Anonymous," AA's 164-page "Big Book," which mixes personal stories of redemption with a description of how the program works.

Other photos in the issue that hits stands today portray the rehab regular cleaning up her act after her July 24 bust for alleged DUI, driving with a suspended license and cocaine possession.

And it look likes her hard work may be paying off.

The celeb Web site TMZ.com is reporting there's a "strong possibility" the Los Angeles County district attorney's office won't slap LiLo with felony charges for the July DUI bust and a previous one over Memorial Day weekend.

Citing law enforcement sources, TMZ said the DA "is not inclined" to hit Lohan hard for the cocaine possession charge - the drug was found in her pants pocket in the July bust and in her system in May.

It all means that the jail time she faces is cut down from up to two years to just a few days.

"She really is taking it seriously," OK! Editor-in-Chief Sarah Ivens said. "She's replacing L.A. and smoking with yoga and reading."

And, Ivens said, "she hasn't looked this good in years."

Lohan spends her days writing in a journal, soaking up "spiritual classes" and working shifts at Smith's, a nearby supermarket, where her earnings go to a local charity, the magazine said.

If that gets too blue collar for her, a source said Cirque offers "equine therapy, where patients care for horses to help them with issues of trust."

"She's been really worried about the influence she's having on her little sister Ali [13]," Ivens said.

"That's why this time she's determined to sort herself out, because she doesn't want her Ali to grow up and suffer the same things she's suffered."

Lindsay Lohan reached a plea deal Thursday on misdemeanor drunken driving and cocaine charges that calls for her to spend one day in jail, serve 10 days of community service and complete a drug treatment program.

She was also placed on 36 months probation, is required to complete an 18-month alcohol education program, pay hundreds of dollars in fines and must complete a three-day county coroner program in which she'll visit a morgue and talk to victims of drunken drivers.

``It is clear to me that my life has become completely unmanageable because I am addicted to alcohol and drugs,'' Lohan said in a statement released by publicist Leslie Sloane Zelnik.

She said she did things she was ashamed of. ``I broke the law and today I took responsibility by pleading guilty to the charges in my case.''

``She's getting what everyone else would get,'' Deputy District Attorney Danette Meyers said after an hourlong hearing in Los Angeles County Superior Court Judge H. Chester Horn Jr.'s courtroom. Terms of the plea bargain were worked out in chambers.

If Lohan were to be convicted of another DUI, she would receive a mandatory 120-day jail sentence, Meyers said. If the actress violates her probation in any way, Meyers added, she could face even more time behind bars: up to a year on each of the drunk-driving and cocaine charges and 90 days on the reckless-driving charge.

``If she violates, it really is up to the judge'' to determine the specific sentence, Meyers said.

Lohan has until Jan. 18, 2008, to complete her jail time, community service and residential drug-rehabilitation program. She must also show proof of enrollment in the 18-month alcohol-education program required of all second-time drunken-driving offenders by that January date.

``No matter what I said when I was under the influence on the day I was arrested, I am not blaming anyone else for my conduct other than myself. I thank God I did not injure others. I easily could have,'' Lohan's statement went on.

Lohan was charged earlier in the day with seven misdemeanors stemming from two drunken-driving arrests in the last four months. More serious felony drug charges were not filed, prosecutors said, because tests showed there wasn't enough cocaine on her to warrant them.

Attorney Blair Berk (who also represented Mel Gibson in his drunken-driving case) entered pleas on Lohan's behalf: she pleaded guilty to two counts of being under the influence of cocaine; no contest to two counts of driving with a blood-alcohol level above .08 percent and one count of reckless driving. Two counts of driving under the influence were dropped.

The judge sentenced Lohan to 96 hours in jail, the mandatory minimum for a second drunken-driving offense. Lohan was given credit for 24 hours already served, and she elected to complete 10 days of community service instead of 48 hours behind bars - an option available to all two-time DUI offenders. She still must serve the balance of her sentence - 24 hours - in city or county jail, Meyers said.

Lohan is being treated at a residential drug-rehabilitation center in Utah. She will remain there for at least 30 days to satisfy her sentence on the cocaine charges, Meyers said.

Lohan was arrested on May 26 in Beverly Hills and on July 24 in Santa Monica. In each incident, the amount of cocaine tested was below the .05 grams required for felony charges, according to the district attorney's office.

Each of Lohan's arrests were followed by trips to rehab, but Meyers noted that ``did not play a part in our agreement.''

Lohan's legal problems come on the heels of two other high-profile celebrity DUI cases that resulted in jail time. Paris Hilton served 23 days behind bars after she was found guilty of driving on a suspended license while on probation for an alcohol-related reckless-driving case. Nicole Richie was ordered to serve four days in jail stemming from a December DUI arrest. She checked in and out of the women's jail in Lynwood on Thursday after serving less than two hours.

Attorney Howard L. Weitzman, who represented Hilton in her probation-violation case, called the judge in Lohan's case ``objective and fair.''

Weitzman, who doesn't represent Lohan, added that she ``appears to be doing what we would all want someone to do in this situation, which is be accountable for her actions and take responsibility for her conduct and make a meaningful effort to change her life.''

Lohan crashed her Mercedes-Benz into a tree on Sunset Boulevard in May and fled the scene to seek medical treatment. Police tests revealed that a white powder found in Lohan's purse was .04 grams of cocaine.

Lohan checked into the posh Promises rehabilitation facility in Malibu after the incident. She left the facility July 13 after six weeks of treatment. She was photographed wearing an alcohol-monitoring ankle bracelet after her release.

Lohan was arrested again on July 24 following a 911 call by Michelle Peck, the mother of Lohan's former personal assistant. Peck told police she was being chased by an SUV. Police later said Lohan was the driver.

Lohan's blood-alcohol level was between 0.12 and 0.13 percent when police found her, officials said. Police also found a white powder in her pocket that was determined to be .02 grams of cocaine.

Lohan started 2007 in rehab at the Wonderland Center in Los Angeles.

Lohan's latest film, ``I Know Who Killed Me,'' opened in July to lackluster response.

``I very much want to be healthy and gain control of my life and career and have asked for medical help in doing so. I am taking these steps to improve my life,'' Lohan said in her statement. ``Luckily, I am not alone in my daily struggle and I know that people like me have succeeded. Maybe with time it will become easier. I hope so.''

Lohan's sentence Thursday was ``the same thing that would happen with respect to anyone else,'' Meyers said. ``And as long as that happens, justice is done.''

Lindsay Lohan Caught Using Drugs, and Having Sex with Other Patients in Rehab

Lindsay Lohan has reportedly been caught taking drugs in rehab.

The 'Mean Girls' star was allegedly forced to undergo a drugs test by staff
at Utah's Cirque Lodge facility, and the results came back positive.

Lindsay, 21, has now been warned if she does not stay clean she will be
thrown out of the center.

A source is quoted as saying: "Lindsay got called into the director's office
on August 15 and was questioned about drugs. When ordered to take a drug
test, she reluctantly complied but screamed and cursed at the medical
director before storming out the room. She was told that if she couldn't
conform to the program she'd have to leave."

According to reports it is not Lindsay's first indiscretion since entering
Cirque Lodge earlier this month.

She is said to have been caught having sex in a toilet cubicle with a male
patient, and is reportedly frequently late to meetings and refuses to do any
chores or menial tasks such as washing up.

Lindsay entered the rehab center following her arrest on July 24 after she
crashed her car following a high-speed car chase in Santa Monica. She was in
possession of cocaine when she was taken into custody.


Last week, Lindsay pleaded guilty to two charges of being under the
influence of a controlled substance (cocaine) and pleaded no contest to two
charges of DUI (driving under the influence of alcohol). She also pleaded no
contest to one charge of reckless driving.

After entering her plea bargain, she was sentenced to one day in jail and 36
months probation for her offenses and ordered to undergo an 18-month alcohol rehabilitation program.

This is the troubled actress' third stint in rehab. She previously stayed at
the Wonderland and Promises facilities in Los Angeles.

LINDSAY LOHAN stand accused of destroying the marriage of a rock star she was reported to have romanced in rehab.

Lohan was linked with Dead Stays Alive frontman Tony Allen earlier this month (Sep07) after they were both patients at the Cirque Lodge Clinic in Utah.

Now Allen's wife Stephanie has filed for divorce, citing reports of his infidelity with Lohan.

Court documents, obtained by British newspaper News Of The World, claim Allen's "habitual drug use" and "conduct and relationship with another woman" were to blame for the split. The 52-page document includes press cuttings of the reports of his fling with Lohan.

Stephanie Allen is quoted saying, "After my husband's return from rehabilitation I was bombarded with calls alerting me to the fact that my husband's conduct with another woman was on the internet and in gossip magazines."

Tony Allen has always denied sleeping with Lohan, insisting at the time, "We're great friends."

Lindsay Lohan’s Rep Denies Lohan’s Involvement in Divorce

British heiress from a family worth $1.4 billion has started divorce proceedings after reports surfaced that her husband, Dead Stays Alive frontman Tony Allen, had sex with Lindsay Lohan while staying at the Cirque Lodge rehab clinic.

According to the Daily Mail, Stephanie Allen, 28, the packaging heiress whose family makes boxes for McDonald’s, filed 52 pages worth of divorce papers last week in in Savannah, Georgia’s Chatham County Court, identifying Lohan as one of the precipitators of the divorce.

In the claim, Stephanie, who is filing for custody of the couple’s 8-month-old twins, states that her marriage is “irretrievably broken" and points to Tony’s “adultery” and “cruel treatment” as grounds for the split. The papers also accuse the musician of being "guilty of habitual drug addiction.”

The lawyers do not name Lohan in the actual complaint but they refer to Tony’s "conduct and relationship with another woman,” and Exhibit 'A', which is attached to the divorce papers, includes articles claiming Lohan, 21, started a relationship with Tony Allen while they were both being treated at the Utah rehab clinic.

Lohan’s rep insists these allegations are untrue. “It’s unfortunate Stephanie Allen is blaming the demise of her marriage on Lindsay,” the rep tells Us exclusively. "Stephanie needs to look at her marriage to determine the reason why things went wrong because it has nothing to do with Lindsay. Lindsay and Tony are friends and that’s all. They are supporting one another through a similar experience. This is a friendship based on trust and mutual support and nothing else.”

The couple have been married since December 18, 2004, and started "living in a bona fide state of separation" about a month ago, according to the documents.

A large amount of money could be at stake in the divorce. In 2002, Stephanie's father and four sisters sold their packaging business Linpac, for $1.4 billion, while maintaining a $197 million stake in the company.

In the affidavit, Stephanie states: "My husband entered a drug rehabilitation centre in Utah...on or about July 11, 2007. After my husband's return from said rehabilitation I was bombarded by telephone call alerting me to the fact that my husband's conduct with another woman was on the internet and in gossip magazines.”

Tony has also denied the rumors, saying: "We're great friends. We share a common affliction, and we just talk about life sometimes."

However, another report claims that Tony was overheard in a bar bragging to friends about sleeping with the actress: "C'mon, it's Lindsay Lohan. Hell, yes! Wouldn't you?"

Lindsay Lohan is being sued by the woman she allegedly chased prior to her arrest for driving under the influence (DUI) last July.

Tracie Rice - the mother of the actress' former assistant - claims Lindsay terrorized her in a high-speed car chase in Santa Monica and is taking legal action.

Legal papers claim Rice - who called emergency services during the pursuit - has spent $3,500 on therapy, $510 on medical expenses, $145 on a chiropractor, $150 on medicine and $2,000 in miscellaneous expenses incurred by her trauma.



Rice also claims she lost her job as a result of the incident, and is seeking compensation against a salary of $60-$75,000 per year.

On July 24 2007 Lindsay allegedly embarked on a high-speed car chase, resulting in her being charged with DUI, shortly after leaving rehab for treatment for alcoholism.

She re-entered rehab the following day and insists she has been sober since her release in October.

Lindsay was seen drinking champagne at a New Year's Eve party in Italy last week, but her lawyer Blair Berk insists she immediately called her sponsor and is getting herself "back on track".

Lindsay is still being sued by Raymundo Ortega, who claims she crashed into his van while driving in Los Angeles in 2005.

The case against Crossheart Productions, the 'Mean Girls' star's production company, has been dropped from the suit, but damages are still being sought from Lindsay.
