New US legislation to bar Internet gaming

A bill is being prepared for the US Senate that will essentially prohibit the use of credit cards, wire transfers or other "instruments of banking" to fund online gambling transactions.

According to an article from Interactive Gaming News dated 29 April, "Prohibition 2005 - A Sneak Peak at the Kyl Bill," Republican Senator Joh Kyl of Arizona is preparing the "Unlawful Internet Gaming Enforcement Act of 2005" to be tabled before the US Congress.

"But unlike previous versions (of the bill), the 2005 bill doesn"t define legal and illegal online gambling activity, nor does it contain a carve-out for online horse betting, an activity that has generated hundreds of millions of dollars for states in which it is currently legal," the article stated.

This newest development sends up a warning flag as Antigua & Barbuda gears up to meet with the US in Geneva later this month to negotiate the stipulations outlined in the recent WTO ruling.

Dr. Cort however, said this recent development was "interesting" but did not faze him in light of previous unsuccessful attempts to pass such a bill.

He added that the government was looking at this development "in terms of mounting a legal challenge to any such entity (including credit card companies) that is going to deny the usage of credit cards or wire transfers for Internet gaming, which we deem would be contrary to the letter and sprit of the recent WTO appellate ruling."

Dr. Cort added that this route might be necessary, "to make it absolutely clear that our gaming operators should be afforded the legal right to engage in these transactions."

why not pass a law that states that it is illegal to use money for anything illegal?

The Following Laws could then be replaced with the "Illegal Funding of Illegal Practices Act of 2005"

Illegal funding of Illegal Marajuana Sales Law

Illegal Hooker Prohibition Funding Act of 2005

Unlawful Funding of Illegal Gambling
