Default I don't understand the Peyton Manning sexual harassment thing

Everyone seems to be bringing it up now, comparing Moss's fake moon to what Manning did.

I never followed the sexual harrassment suit, and everybody but railbird seems to make light of it. I did a quick look this morning and found an archived item (a kobe article that refers to the Manning case as well) where the guy says:

"A female trainer, after suffering his continual acts of sexual harassment, had enough when Manning exposed his naked buttocks to her and nearly sat on her face. The media remained low key, and Manning was able to settle his case with very little fanfare.

Manning’s behavior, which bordered on the legal definition of rape, was minimized and labeled as “a lapse in judgment.” By the time the media finished polishing up Manning's bad conduct, those who happened to read the small print of the sports page, would be under the impression that he’d merely mooned her. The incident was made to have been simply a childish prank misconstrued by the public."

INDIANAPOLIS -- Former NFL quarterback Archie Manning believes son Peyton has been punished enough for a mistake he made seven years ago and that a defamation lawsuit should have been dismissed.


In an interview with The Associated Press, the elder Manning said his son regrets dropping his pants in front of a University of Tennessee trainer and tried to apologize to her.


"He felt it was his mistake, he tried to apologize and he was remorseful," Archie Manning said Tuesday night. "He got punished and he took his punishment."


The 1996 encounter between the trainer and the Indianapolis Colts quarterback is mentioned in a book the Mannings wrote, "Manning: A Father, His Sons and a Football Legacy."


In the book, Peyton Manning says he pulled down his pants and conceded that his behavior was "inappropriate."


"Crude, maybe, but harmless," he wrote.


He also wrote that the trainer had a "vulgar mouth," which she claimed defamed her and cost her a subsequent job.


Earlier this week, a judge ruled there was enough evidence for the trainer's lawsuit against the Mannings to proceed, and a trial was set for March. Though she's not named in the book, Jamie Ann Naughright says the passages disparaged her.


Archie Manning said he was dismayed that the "feel-good" book is now the subject of legal action.


"Obviously, my wife and I and our family hurt for Peyton at a time like this," he said. "We're sad for him, especially since an incident from seven years ago seems to have gotten so twisted."


Naughright filed the lawsuit in Polk County, Fla., in 2002, two years after the book was published. In the lawsuit, she accuses Manning of placing his "naked butt" on her face while in the Volunteers' locker room. She is seeking damages of at least $15,000.


In 1997, she agreed to a $300,000 settlement with the university over 33 alleged instances of sexual harassment surrounding her job in the athletic department, and her complaint included the encounter with Manning. Manning was not personally accused of sexual harassment, and a university investigation characterized it as "horseplay."


Manning's attorney, Slade Metcalf, argued in court papers that the lawsuit should be thrown out because the passages in the book are "substantially" true. He also contends the settlement released the university, its employees and students, including Manning, from additional damages.


"That's what we feel, that's what I feel, that's the way Peyton feels," Archie Manning told the AP.


Peyton Manning declined to comment.


Naughright's attorney, Robert Puterbaugh, also wouldn't comment.


Judge Harvey Kornstein ruled Monday that there was enough evidence to suggest the Mannings, the writer and the publisher knew the passages were false and acted in reckless disregard for the truth.


The lawsuit also names writer John Underwood and publisher HarperCollins Inc.


"Peyton knows people have a right to say what they want about him," Archie Manning said. "He said what happened seven years ago and it's still true."

Trainer's settlement involved more than Manning's mooning

KNOXVILLE, Tenn. (AP) - Trainer Jamie Whited's sexual harassment claims against the Tennessee men's athletic department didn't begin when quarterback Peyton Manning ``mooned'' her in the locker room.

Records released Tuesday by the university suggest Ms. Whited, 28, endured a long list of slights, affronts, embarrassments and, possibly, threats within the Volunteer athletic complex dating to 1990.

She reached a $300,000 settlement with the university last week and agreed to resign. UT announced the agreement late Friday without disclosing the extent of her complaints.

President Joe Johnson confirmed Tuesday the settlement will be paid with revenues from the athletic department, not taxpayer dollars.

A UT investigation conducted after Ms. Whited filed the complaint last year verified at least four of her 33 claims involving athletes, trainers, coaches and administrators. It noted athletes or trainers received some form of discipline in other cases.

But the report also contained some denials and memory lapses by Ms. Whited's colleagues and administrators. In those cases, investigators reached no conclusion and dismissed the claims as vague or too general.

Investigators concluded ``both parties share responsibility for the current environment.''

``Ms. Whited often sent mixed messages about matters complained of in her allegations in that she herself exhibited similar behavior or did not make clear that she found particular conduct to be offensive,'' the report said.

``Likewise, the Athletics Department administration could have avoided some problems by more clearly conveying to Ms. Whited the basis for actions she considered to be discriminatory.''

People interviewed by investigators said Ms. Whited frequently used profanity in an effort, as one put it, ``to prove that she was one of the boys.''

Ms. Whited gave a different account in the complaint filed Aug. 27, 1996. She said sexual harassment allegations at UT ``are treated as jokes and efforts are made to protect the student-athlete, and cover up the complaints.''

Among Ms. Whited's complaints were that she was embarrassed by the nickname ``Bumper,'' which she said athletes gave her because of her breast size.

She also said she was the subject of a song with sexual innuendo sung by the track team, had student trainers barge into a storage room where she changed clothes and received warnings that ``other athletes were referring to me in a sexual manner and that I should be concerned for my safety.''

But it was the incident involving Manning, considered among the favorites for the Heisman Trophy, that apparently was the final straw.

On Feb. 29, 1996, Manning exposed his buttocks as Ms. Whited bent over to examine his foot in a training room. Manning called it a prank intended for another athlete, apologized and was punished with extra running.

Ms. Whited cited the incident as the reason for taking a medical leave.

She was unavailable to comment Tuesday. A message on her home answering machine said she was grateful for the ``opportunity for academic and professional achievement'' at UT over the past 11 years.

``I will spend my educational leave expanding my research on health issues related to football student-athletes,'' she said.

Marilyn Hudson, her attorney, called it ``an arduous ordeal. We are glad it is over with.''

``It takes a lot for anybody to come forward,'' said Ms. Hudson, a specialist in sex discrimination cases, ``and the larger and more influential the employer, the more courage and bravery it takes.''

Some university officials were upset that Manning received the brunt of attention from the complaint. His father, former NFL quarterback Archie Manning, took it in stride.

``I know that around the country people kind of put their own headlines on stories,'' he said. ``But that's just the way it is. I'd just like for it to die now. I believe it will.''

As part of her settlement, Ms. Whited agreed to turn over tape recordings of university employees made during her employment. University officials refused to say what is on the tapes.

According to the pact, UT will hold them in a safe deposit box through June 30, 2005, then destroy them.

How about that Fat Pig Chris Berman and his quota hire partner Tom Jackson talking about Moss having no class, then they go to the highlights of the Colts game and Berman says now we go to someone with class Peyton Manning. Shows what hyporcrticial scum the media is.

Sounds like a story where the girl enjoyed talking dirty like one of the guys and enjoyed the attention the young college guys were giving her then decided to cash in on it.

BUTTbuddy, you should be the expert on this case. I personally just hope that Peyton can put this problematic case BEHIND him and kick some ASS against New England.

Peyton Manning never shows up in the big game where it actually counts. His stats next week:

276 yards passing, 3 tds, 1 int but you know what, with far inferior stats Tom Brady will do what he does best in the playoffs: win

I guess any old dumbass can make a fortune for basically no reason by way of the almighty law suit. she got more than 10X her annual salary in the 300K settlement, now she wants even more. heartwarming.

Bird, get over it. Admit you hate Manning, a true role model as a player and human being, only because you he made you look like an idiot when you, seemingly forever, insisted that Ryan Leaf was better than Peyton.

Peyton is a sexual predater, he is scum just like his old man Archie is. Reno, you are pretty stupid, Manning lead the leauges in picks for 6 straight years. Manning is 0-4 vs Fla Gators 0-6 vs Ne Patriots, 0-2 vs Mcnair in playoffs. Frankenstein likes to run up td totals in blowouts vs weak teams that have quit. Peyton is FURTHER scum because he attacks girls character in a book 6 years later. Reno is a sterotypical that worships media made heros.

Bird, you're out to lunch. Instead of accusing Peyton of being a sexual predator, why don't you do something constructive: Load your pipe up with some of that organic wheatgrass, take a few hits, and let us know the latest apocalyptic prophecies based on your in-depth eschatology studies.
