Update: Us DOJ Gets Extension in Online Gambling Prohibition Legal Challenge

In the case of iMEGA v. Gonzales, et al, the US District Court of New Jersey has granted the defense's motion to extended the deadline for responding to iMEGA's original complaint, filed on June 5th of this year, against the Unlawful Internet Gambling Enforcement Act (UIGEA).


Now the defendants - the US Department of Justice (US DoJ), the Federal Trade Commission (FTC), and the Federal Reserve Board of Governors - have until Sept. 4th to submit their response to iMEGA's complaint. The initial deadline for the defense to respond had been August 17th.


While this extension does not directly affect the Sept. 4th date for the initial hearing before the Hon. Mary L. Cooper, US District Court judge of New Jersey (Trenton division), the defendants may still request an extension on the date of that hearing as well.

I'm trying hard not to be overly optimistic, not even sure if it's possible to get a fair hearing on a constitutional matter anymore. But man, I sure hope the UIGEA gets voided for what it is, an obtrusive and very dangerous act that threatens the liberties of everyone, non-gamblers included. A dangerous precedant that gives the government the authority to penalize and even arrest bankers who simply cash and honor your viable bank drafts.
